TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing www.heatvia.com (the "Site") or purchasing Products, you agree to these Terms of Service ("Terms") between you and HIGOSELECT LLC ("Heatvia", "we", "us"). If you do not agree, do not use the Site.

2. ELIGIBILITY

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Site or place an order.

3. ACCOUNTS

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

4. ORDERS & PRICING

We reserve the right to refuse or cancel any order, and to correct pricing or availability errors. Prices are listed in U.S. dollars and are exclusive of taxes and shipping unless stated.

5. PRODUCT CONFIGURATION, BATTERY OPTIONS & SAFETY

Battery inclusion depends on the product and variant selected at checkout. Some Heatvia heated apparel is sold as a garment-only “Battery-Free Model” and does not include a power bank. Other variants expressly identified as “With Battery” or “With 10,000mAh Battery” include the battery or power bank specified on the product page. The selected product variant, cart, checkout page, and order confirmation determine what is included in the purchase. Customers should not assume that a battery is included unless the selected variant expressly states that it is included. Battery-free garments require a compatible power source that meets the voltage, current, connector, and other requirements stated in the applicable product instructions. Heatvia is not responsible for damage caused by an incompatible, damaged, modified, or improperly used third-party power source. Before washing a heated garment, disconnect and remove the power source and follow the care instructions on the garment label and product page. Do not use the heating function while the garment is wet. Stop using the garment or battery immediately if it becomes unusually hot, swollen, damaged, leaking, or otherwise abnormal, and contact Heatvia Support.

6. INTELLECTUAL PROPERTY

The Site, its content, and the Heatvia name, logos, and trademarks are owned by HIGOSELECT LLC or its licensors and are protected by law. You may not use them without prior written permission.

7. PROHIBITED CONDUCT

You agree not to misuse the Site, attempt unauthorized access, infringe IP, or engage in fraudulent or unlawful activity.

8. DISCLAIMERS AND NON-WAIVABLE CONSUMER RIGHTS

Product descriptions, specifications, availability, and compatibility information are provided with reasonable care but may vary by product model and selected variant. Except as expressly provided in the applicable Heatvia Limited Warranty, and only to the maximum extent permitted by law, Heatvia disclaims warranties that may lawfully be disclaimed. Nothing in these Terms excludes, restricts, or modifies any warranty, consumer right, remedy, or liability that cannot legally be excluded or limited under applicable federal or state law. Nothing in these Terms limits liability for personal injury or property damage caused by a defective product where such a limitation is prohibited by law.

9. LIMITED WARRANTY

Certain Heatvia products are covered by a 12-month limited warranty against defects in materials or workmanship, as described in the Heatvia Limited Warranty available on our Site. Warranty coverage may vary by product and by the variant selected at purchase. If a selected variant includes a Heatvia-supplied battery or power bank, the warranty terms applicable to that battery will be stated in the Limited Warranty. Batteries or power sources purchased separately from third parties are not covered by Heatvia’s warranty. Customers must be given access to the applicable warranty terms before completing a purchase. The Limited Warranty does not affect any consumer rights or remedies that cannot be limited under applicable law.

10. INDEMNIFICATION

You agree to indemnify HIGOSELECT LLC against claims arising from your misuse of the Products or violation of these Terms.

11. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any legal action arising from these Terms must be brought in a state or federal court located in Colorado.

12. CHANGES

We may modify these Terms at any time. Continued use after changes constitutes acceptance.
